01. Scope & Contracting Party
These Terms and Conditions govern the relationship between æternacy UG (haftungsbeschränkt) (Amtsgericht München, HRB 311168), represented by Managing Director Florian Drahorad, Franz-Joseph-Straße 11, 80801 Munich, Germany ("Provider") and the users of the æternacy platform.

02. Subject Matter
æternacy UG (haftungsbeschränkt) provides a digital institution for family archiving. Services include secure media storage, AI-powered curation and narrative creation through the "æterny" assistant, as well as the professional digitization service "Archive Rescue".
03. Registration & Eligibility
Users must be at least 16 years old to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
04. Pricing, Crædits & Right of Withdrawal
We offer various subscription tiers (Essential, Family, Family Plus, Legacy). Compute-intensive AI operations consume "Crædits". Payments are processed via Stripe. Consumers in the EU have a statutory 14-day right of withdrawal from the date of contract conclusion.
05. Intellectual Property
Users retain all ownership rights to their uploaded media. You grant æternacy UG (haftungsbeschränkt) a non-exclusive, worldwide, royalty-free license to process your media solely for the purpose of providing the agreed services within your private vault.
06. Prohibited Use
Users may not upload illegal content, including material that infringes third-party rights, is defamatory, or violates youth protection laws. Automated scraping of the platform is strictly prohibited.
07. Availability
We aim for an average annual availability of 99.5% for our digital services, excluding scheduled maintenance windows and events beyond our reasonable control.
08. Limitation of Liability
The Provider is liable for damages caused by intent or gross negligence. In the case of slight negligence, liability is limited to the breach of material contractual obligations (cardinal obligations).
09. AI-Generated Content
The æterny assistant and other AI-powered features of the platform generate content automatically based on your data. This AI-generated content (narratives, analyses, insights, image edits) serves solely as an aid and does not constitute advice, factual assertion, or guarantee of accuracy. The Provider makes no warranty regarding the accuracy, completeness, or suitability of AI-generated content. Usage rights to AI-generated content within your archive remain with you.
10. Termination & Data Export
Subscriptions may be cancelled according to the chosen billing cycle. After cancellation, users have a 30-day window to export their archive before data is scheduled for deletion.
11. Succession Clause
æternacy UG (haftungsbeschränkt) offers a "Succession Protocol" that allows users to designate heirs. In the event of a verified death or extended inactivity, account access can be transferred to designated stewards.
12. Changes to Terms
We reserve the right to modify these terms. Users will be notified at least 30 days in advance of any changes. Continued use after changes take effect constitutes acceptance.
13. Final Provisions
This agreement is governed by German law. The place of jurisdiction is Munich, Germany.
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of the contract conclusion. To exercise your right of withdrawal, you must inform us (æternacy UG (haftungsbeschränkt), Franz-Joseph-Straße 11, 80801 Munich, Email: info@aeternacy.com) by means of a clear declaration (e.g. a letter sent by post or email) of your decision to withdraw from this contract.
